Potentially, yes.

Being hospitalized does not automatically mean a patient cannot sign legal documents.

  • Receiving treatment

and still be capable of understanding and voluntarily signing a document.

The patient must still be able to personally complete the required signing and notarial act.

 


 

The Patient Must Still Be Able to Execute the Document

Timing matters.

A family member cannot simply sign a new Power of Attorney for a patient who is already unable to execute it.

The person granting the authority is the principal.

If the principal can no longer execute the document, a new POA may no longer be an available solution.

The family may need to consult a Florida attorney regarding other options, potentially including guardianship or another court process.

 


 

Don't Wait Until the Patient Can No Longer Communicate

Families sometimes wait until the situation becomes critical.

Then we receive a call like:

“Dad can no longer communicate, but we need his Power of Attorney immediately.”

At that point, it may be too late to execute a new POA.
